Plan B Media Public Company Limited (the “Company”, “we”, “us”, and “our”), our subsidiaries and affiliated companies recognize the importance of the personal data protection of individual, therefore, we provide this Privacy Policy to inform you of our policy in relation to the collection, use and disclosure of personal data of the user of our website, customers, business partners, employees, agencies, and any other persons related to any activities or services of the Company (Collectively referred to as “you” or “your”) in accordance with Personal Data Protection Act B.E 2562 (“PDPA”) including relevant laws and regulations. This Privacy Policy is intended to inform you of how we collect, use or disclose your personal data, what rights you have and how you can contact us.

We collect your personal data that you give directly to the Company or available to the Company by the use of our services, contact, visit, website or search and we may also collect your personal data received or accessed by the Company from other sources e.g., our subsidiaries, affiliated companies, government authorities or any third-party service providers, however, we will collect your personal data from other sources only when your consent is given according to PDPA.

The personal data we collect will include, but not limited to the following type of personal data:

  3. It is necessary for compliance with laws which the Company is subjected

We may disclose your personal data under the provisions of PDPA to our subsidiaries and affiliated companies, other persons or entities e.g., external service providers, personal data processors, auditors or external auditors, and Governmental authorities and/or supervisory or regulatory authorities. We will ensure that such third parties receiving your personal data will collect, use or disclose your personal data to the extent permissible under your consent and safeguard your personal data in accordance with this Privacy Policy. We may also disclose your personal data to the third parties for the following purpose:

  1. For compliance with laws or an order from the government authorities;
  2. It is necessary to prevent and investigate fraud, misconduct, or other crimes;
  3. The disclosure of your personal data is necessary for the public interest; or

We may send or transfer your personal data as necessary to other countries for the performance of a contract which you are a party, or to take step at your request before entering into a contract e.g., sending or transferring your personal data to be processed on server or cloud in other countries. In this case, we will use our best effort to ensure that the sending and the transferring are in compliance with the requirements under PDPA by entering into confidentiality agreement with receivers in such country or, if our subsidiaries or affiliated companies is the receiver, setting out the privacy policy and controlling the sending and transferring to comply withs such privacy policy.

  1. Retention Periods

We will retain your personal data for as long as necessary in connection with the purposes set out in this Privacy Policy unless there is longer retention period a period of time as required or permitted by laws.

For the retention of your personal data, we implement administrative, technical, and physical security measures to help protect your personal data from unauthorized access, use, or discloser e.g., we keep your personal data on a computer server with limited access and when we transfer your personal data over the internet, we protect it through the use of encryption and we make a reasonable effort to ensure that our executives, employees, contractors, agents, advisor, and data receivers are obligated to keep your personal data confidential according to this Privacy Policy.

Right to access and/or correct your personal information: you have the right to access and to be provided with a copy of your personal data (in most circumstances) and request us to reveal how we obtain your personal data without your consent. You also have the right to correct your inaccurate personal data or to update your in completed personal data.
  2. Right to withdraw your consent: you have the right to withdraw your consent that has been given to us at any time unless it is restricted by laws or you are still under beneficial contract.
  3. Right to object to processing of your personal data: you have the right to object the collection, use and disclosure or your personal data where we have used legitimate interests as the basis for processing or for the marketing purpose. In such cases, we will stop processing your personal information until we verify that we have compelling legitimate grounds for processing that outweigh your rights in asking us to stop processing the data, or in limited cases where we need to continue processing the data for the establishment, exercise, or defense of legal claims.
  4. Right to request deletion of your personal data: you have the right to request us to delete your personal data in certain circumstances.
